TraDigitalArt Refunds and Returned Goods Policy

Return/Refund Policy for:  DIGITAL GOODS

All purchased downloadable digital artworks are not eligible for return and they cannot be refunded.  Tradigital Artech Ltd doesn’t accept any return of purchased digital artworks and doesn’t refund consumer-buyers after purchasing a digital artwork.

Return/Refund Policy for:  ORIGINAL ARTWORKS

On tradigitalart.online you can also buy original tangible artworks from all over the world, shipped directly from artists.

Tradigital Artech Ltd doesn’t refund consumers for returned original artworks after the statutory period. Tradigital Artech Ltd doesn’t accept any return of purchased artworks. In case of returned tangible goods, Tradigital Artech Ltd is not responsible for any shipping costs. Moreover, Tradigital Artech Ltd will not provide compensation to artists for purchased artworks that customers return.

The statutory cancellation period ends at the end of 14 days after the day on which the goods come into the physical possession of—

(a)the consumer, or

(b)a person, other than the carrier, identified by the consumer to take possession of them.

Consumer-buyers have the right to cancel distance sales at any time, without giving any reason, during the statutory cancellation period, which is 14 calendar days from the day on which the consumer, or the person other than the carrier, identified by the consumer to take possession of the purchased goods, takes possession of them. In order to assert the right of cancellation or withdrawal of sales, the consumer-buyer must provide the delivery note certifying the date of deliverance and of consequent taking possession of the purchased goods.

It is not Tradigital Artech Ltd responsibility to collect the goods in the event of cancellation of a sale contract.  Where a sales contract is cancelled, the consumer-buyer must send the goods back to the return sender artist address without undue delay, and in any event not later than 14 days after the day on which the consumer informs tradigitalart.online of the cancellation of the sale contract, as required by regulation. The consumer-buyer who cancels the sale contract must bear the direct cost of returning goods. The consumer-buyer who returns goods is responsible for any shipping costs.

In the event of withdrawal or cancellation of sales by consumer exercised within the statutory period, Tradigital Artech Ltd will reimburse the consumer not later  than the end of 14 days after the day on which the sender artist receives the goods back.

The consumer’s refund will be made net of shipping and related expenses, if the artist has taken care of these expenses.

If the returned artwork suffered damage not attributable to transport and handling and shipping services, the consumer’s will pay the total amount of the purchased and returned artwork.

Return/Refund Policy for:  PRINTS

On tradigitalart.online you can buy prints of digital artworks that are shipped worldwide.

Tradigital Artech Ltd doesn’t refund consumers for returned tangible goods after the statutory period.  Tradigital Artech Ltd doesn’t accept any return of purchased prints. In case of returned prints, Tradigital Artech Ltd is not responsible for any shipping costs. Moreover, Tradigital Artech Ltd will not provide compensation to artists for purchased artworks that customers return.

If the Customer discovers any defect, such as damage to the delivered Products, errors in the number or quantity of the delivered Products or lack of quality of the delivered Product not caused by lack of quality of the User Content, the Customer must, in order to avail itself the rights provided for below, notify Tradigital Artech Ltd at the following e-mail address: [email protected] and return the print to the address of the Print House, within 5 days after receipt of the Product. The Customer may be requested to provide photographic or other documentary evidence of the existence of a defective Product.

If Tradigital Artech Ltd agrees to, or the Customer can substantiate, the defect, and the defect is not due to the carrier of a non-tracked delivery, to errors in the information provided and the choices made while ordering, to force majeure or other circumstances outside Tradigital Artech Ltd’s control, then Tradigital Artech Ltd will, at its option, either provide the Customer with a reprint of the order to the extent required to remedy the defect or offer the Customer
a refund for the defective Products. The remedies provided for above are the Customer’s sole remedies for any defective Product, and exclude, to the
fullest extent permitted by law, any other remedy available to the Customer by law.
